Terms of Service

1. About NexSMM

NexSMM (https://nexsmm.co) is an online social media marketing panel that connects customers with third-party social media marketing service providers. We offer services such as follower growth, post engagement, video views, and other promotional services across platforms including Facebook, Instagram, TikTok, YouTube, Twitter/X, Threads, and Google.

NexSMM acts as a reseller. We process your orders and deliver them via our service providers. We do not guarantee specific outcomes beyond the service quantities described on each listing.

2. Eligibility

You must be at least 18 years old to use NexSMM. By registering, you confirm that all information you provide is accurate and that you have the legal capacity to enter into this agreement.

3. Accounts

• You are responsible for maintaining the security of your account credentials.
• You may not share your account or use another person's account without permission.
• You must notify us immediately at support@nexsmm.co if you suspect unauthorized access.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Payments & Balance

Services are paid for by depositing funds into your NexSMM account balance. Deposits are processed securely through Stripe. Once deposited, funds are credited to your account and can be used to place orders.

• All prices are displayed in your selected currency. The base currency is Vietnamese Dong (VND).
• Deposits are non-refundable except in cases of a service failure on our part (see Section 5).
• Account balances hold no cash value and cannot be transferred to other users.
• We reserve the right to change pricing at any time. Prices are confirmed at the time of order.

5. Refunds & Cancellations

Due to the nature of digital marketing services, we generally do not offer refunds once an order has started processing. However, we will credit your account balance if:

• An order fails to start within a reasonable time due to a system issue on our end.
• A service becomes permanently unavailable after you placed an order.
• You are charged more than once for the same order due to a technical error.

Refund requests must be submitted to support@nexsmm.co within 7 days of the issue. We do not offer refunds for orders that were delivered as described, even if results are not what you expected.

6. Service Delivery

Delivery times are estimates and may vary based on service load and provider availability. NexSMM does not guarantee instant delivery on all services. Orders are processed automatically and cannot be cancelled once they have started.

Social media platforms regularly update their algorithms and policies. NexSMM is not responsible for content removal, account restrictions, or drops in metrics that occur after delivery as a result of platform-side actions.

7. Prohibited Uses

You agree not to use NexSMM to:

• Promote illegal content, hate speech, violence, or adult content.
• Harass, threaten, or harm any individual or group.
• Violate any applicable local, national, or international law.
• Attempt to reverse-engineer, hack, or disrupt our platform or services.
• Resell or redistribute our services without prior written consent.
• Create multiple accounts to circumvent bans or restrictions.

You acknowledge that using our services may interact with third-party platforms (such as Instagram or TikTok) and that those platforms have their own Terms of Service. You are solely responsible for ensuring your use of NexSMM complies with the rules of those platforms.

8. Rank System

NexSMM offers a rank-based discount system. Your rank is determined by your total cumulative deposit balance. Ranks and their corresponding discount rates are displayed on the platform and may be changed by NexSMM at any time with reasonable notice. Discounts apply to order prices at the time of purchase.

9. Limitation of Liability

To the maximum extent permitted by law, NexSMM and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to:

• Loss of followers, engagement, or account standing on social media platforms.
• Platform bans, restrictions, or penalties imposed by third-party platforms.
• Failure to achieve marketing or business objectives.

Our total liability to you for any claim shall not exceed the amount you paid to NexSMM in the 30 days preceding the claim.

10. Intellectual Property

All content on the NexSMM platform — including the name, logo, interface, and software — is the property of NexSMM and may not be copied, modified, or redistributed without written permission.

11. Modifications to Terms

We reserve the right to update these Terms at any time. Continued use of NexSMM after changes are posted constitutes acceptance of the new terms. We will notify registered users of significant changes via email where possible.

12. Governing Law

These Terms are governed by the laws of Thailand. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Thailand.
